Finn Moray's
Refund & Digital Rights Policy
Refund & Digital Rights Policy
Effective Date: 5 September 2025
Jurisdiction: Scotland, United Kingdom
Legal Owner: Sheret Energy Offshore Ltd (trading as “Finn Moray”)
Purpose and Scope
This policy sets out your rights and obligations when purchasing downloadable music or related digital assets from this website (the “Site”), whether created by traditional means or using artificial intelligence (“AI”). All content and associated rights are legally owned by Sheret Energy Offshore Ltd (SEO). Use of any work remains subject to the Social Compact values and governance that underpin the project and the proposed charitable structure and oversight.
Nature of the Content
The Site offers digital content including, without limitation, musical compositions, sound recordings, stems and artwork, created by human musicians and/or produced using AI tools under licence and direction. All content is protected by copyright and related rights and is supplied for personal use only, under licence, on the terms below.
No Right to Cancel Once Download Begins
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you do not have a right to cancel once download or streaming of digital content has begun, provided that you were informed of this prior to purchase and gave your express consent to proceed. By completing a purchase and commencing the download or access, you expressly agree to waive the 14‑day statutory cancellation period. No refunds will be issued after download has started, except where the content is faulty as set out in section 4.
Operational note: before checkout you will be asked to confirm that you understand download will begin immediately and that you consent to the waiver of your cancellation right. A confirmation email will record your consent for evidential purposes.
Faulty, Inaccessible or Corrupted Downloads
If a file is inaccessible, incomplete or corrupted due to a fault on our side, we will:
-
re‑issue a working version without additional charge; or
-
issue a full refund if the fault cannot reasonably be remedied.
Requests must be made within 7 calendar days of purchase and must include the order number, a description of the issue, and reasonable confirmation that the problem is not caused by your device, software, player, DRM settings, or internet connection.
Duplicate or Unauthorised Purchases
-
Duplicate purchases: if you accidentally buy the same track or album more than once, we will refund the duplicate charge if you notify us within 7 calendar days and the duplicate is verifiable on our system.
-
Unauthorised use of your account: you are responsible for safeguarding your login and payment credentials. We are not liable for purchases made using your credentials without your permission. If you suspect unauthorised access, change your password immediately and contact us; we may, at our discretion, assist with preventative measures on future transactions.
Grant of Licence; No Transfer of Rights
Your purchase grants a non‑exclusive, non‑transferable, revocable personal licence to download and play the music for private, domestic use only. You may not copy, re‑upload, share, seed, resell, lease, sub‑license, broadcast, publicly perform, synchronise with video, train AI systems, or otherwise commercialise the content without a separate written agreement and a commercial licence from SEO. You must not claim authorship or ownership of any part of the works, whether human‑created or AI‑assisted. All intellectual property and neighbouring rights remain with SEO as rights holder.
AI‑Related Terms
Creation: certain works may have been created or assisted by licensed AI tools. That does not reduce or limit our intellectual property rights.
Prohibited uses: you must not use our files, stems, lyrics or melodies to train or fine‑tune AI systems; to generate derivative catalogues; or to create deceptive replicas of the artist’s voice or style.
Derivatives and remixes: any remix, cover, sample or derivative requires prior written consent and a licence. Where authorised, derivatives must comply with attribution, quality and ethical standards consistent with the Finn Moray project and the Social Compact, including revenue‑sharing where applicable.
Moral and Community Standards
You must not use the content in ways that distort artistic intent, promote hate or discrimination, or harm the reputation of the artist, the project, or the communities referenced by the works. We may revoke licences for misuse and seek appropriate remedies.
No Warranty; Service Levels
Digital content is provided “as is” without any warranty or representation, express or implied, including fitness for a particular purpose, uninterrupted availability, compatibility, accuracy of metadata, or artistic quality. We do not warrant that files will operate on every device, player, or operating system. Your statutory rights are not affected where they cannot be excluded by law.
Limitation of Liability
To the fullest extent permitted by Scots law, our total aggregate liability to you for any loss or damage arising out of or in connection with a purchase on the Site shall not exceed the price paid for the affected item. We shall not be liable for indirect or consequential loss, including loss of profit, revenue, data, business or goodwill.
Evidence and Anti‑Fraud
We reserve the right to use transaction logs, server records and anti‑fraud checks to investigate suspected abuse, chargebacks or licence violations. Where reasonably necessary we may suspend access pending investigation.
Governing Law and Jurisdiction
This policy and any non‑contractual obligations arising out of or in connection with it are governed by the laws of Scotland. The Scottish courts shall have exclusive jurisdiction over disputes. Without limiting that right, parties may agree in writing to attempt mediation first.
Amendments
We may update this policy from time to time to reflect legal or operational changes. The latest version will be posted on the Site and applies from its stated effective date. Continued use of the Site after publication constitutes acceptance of the updated terms.
